The U.S. Court of Appeals for the Federal Circuit (CAFC) on July 9 affirmed a district court's grant of judgment as a matter of law (JMOL) invalidating Wyeth LLC's two patents covering methods of cancer treatment, finding the asserted claims lacked enablement under 35 U.S.C. § 112(a). The precedential decision wipes out a $107.5 million jury verdict Wyeth had previously won against AstraZeneca Pharmaceuticals over the latter's blockbuster EGFR (search) inhibitor Tagrisso (osimertinib).
The case centered on U.S. Patents 10,603,314 and 10,596,162, which claimed methods of treating gefitinib/erlotinib-resistant non-small cell lung cancer (search) (NSCLC) by administering a daily "unit dosage" of an irreversible EGFR (search) inhibitor that covalently binds to specific cysteine residues on the enzyme.
The Enablement Dispute
The district court had construed "unit dosage" according to the specification's own definition: "physically discrete units suitable as unitary dosage for the subject, each unit containing a predetermined quantity of active material calculated to produce the desired therapeutic effect." While a jury initially found the patents not invalid and awarded Wyeth $107.5 million, the district court granted AstraZeneca's renewed JMOL motion post-verdict, concluding the claims were not enabled.
The district court found that "identifying the unit dosage for even just a single compound is highly unpredictable and involves a tremendous amount of work and experimentation." Critically, AstraZeneca "presented unrebutted evidence that some disclosed dosage levels would be toxic, including doses required to achieve a therapeutic effect in patients."
Federal Circuit's Analysis
Writing for the court, Judge Lourie emphasized that the specification left determination of the claimed "unit dosage" entirely to the skilled artisan. "While the knowledge of one of ordinary skill may play an important role in enablement, it may not provide the only means to enable these specific claim limitations," Lourie wrote.
The CAFC noted that the specification provided only three exemplary compounds and disclosed only in vitro data, without "any further description of (1) how to extrapolate in vivo dosing from those in vitro results or (2) any other teachings sufficient to allow a skilled artisan to calculate a 'unit dosage' as claimed." The court concluded that "in vitro data alone are insufficient to enable these claims."
Although the specification recited dosage ranges, the CAFC observed that "they are qualified as 'general'… and 'projected'… ranges, and the specification provides no further explanation of how those ranges were derived, how a skilled artisan would select among them for a given compound, or how they relate to the claimed unit dosage calculated to produce a therapeutic effect in a patient."
Toxicity Evidence Proves Decisive
AstraZeneca provided unrebutted evidence—and Wyeth's own experts agreed—that the therapeutically-effective dosage levels for compounds disclosed in the specification "far exceed the maximum tolerated dose in humans," in one case by a factor of five. "Such testimony reinforces the lack of guidance provided by the specification," the CAFC stated.
The court acknowledged the accepted practice of claiming a range of doses without clinical data but distinguished these patents: "The problem with these patents is that, perhaps because of close prior art, their claims are limited to dosage forms to be administered to patients, yet they disclosed only a broad range of doses some of which were shown to be toxic, and they disclosed no actual dosages for any compound within the scope of the claims, thereby leaving it to a practitioner of the claims to perform undue experimentation."
Wyeth's Arguments Rejected
Wyeth argued on appeal that the district court improperly imported FDA-style clinical safety and efficacy requirements into the claims. The CAFC rejected this, explaining that the claim language itself—requiring daily administration of a unit dosage "to the patient" to produce a therapeutic effect—"plainly require[s] the daily administration of a unit dosage to a patient to achieve a therapeutic effect in treating g/e-resistant NSCLC, not merely the identification of compounds capable of inhibiting EGFR (search) activity in vitro."
The CAFC also noted that the specification's own language acknowledged that precise dosing "depend[s] on the judgment of the practitioner and are peculiar to each individual," which underscored the complexity left unresolved by the patent.
Strategic Implications
The decision signals that courts will scrutinize functionally defined dosage limitations with rigor comparable to that applied to genus claims covering broad compound classes. For patent drafters, the case underscores the importance of including working examples that bridge in vitro data to in vivo dosing and verifying that disclosed dosage ranges are consistent with known toxicity data. For litigators, enablement challenges to method-of-treatment patents may increasingly focus on whether the specification actually teaches a workable dosing regimen, particularly where unrebutted testimony from a patent owner's own experts or inventors regarding toxicity or dosing limitations can prove dispositive.
