Under the new framework, pharmaceutical companies will receive an eight-year regulatory data protection period, during which competitors cannot access product data, followed by one additional year of market protection preventing the sale of generic or biosimilar products. The agreement establishes a cap of eleven years on the combined regulatory protection period.
Companies can earn additional market protection periods of 12 months each under specific conditions: if the product addresses an unmet medical need, contains a new active substance meeting combination requirements for comparative clinical trials conducted across multiple member states, or receives authorization for new therapeutic indications providing significant clinical benefit compared to existing therapies.
Breakthrough orphan medicinal products (search) addressing diseases with no current available treatment will benefit from up to eleven years of market exclusivity. The deal clarifies the scope of the "Bolar" exemption, allowing manufacturers to conduct studies, trials, and other activities during the original product's market protection period for obtaining marketing authorizations, health technology assessments, pricing approvals, and procurement applications without infringing patent rights.
Antimicrobial Resistance Measures
The agreement introduces a "transferable data exclusivity voucher" system for priority antimicrobials (search), granting 12 additional months of data protection for one authorized product. This 12-month extension can be used once, either for the priority antimicrobial or another centrally authorized medicinal product from the same or different marketing authorization holder.
