Republican Senator Josh Hawley of Missouri expressed similar concerns, stating on social media platform X that he had "lost confidence in the leadership at FDA."
An FDA spokesperson defended the agency's actions, emphasizing that the FDA "has very limited discretion in deciding whether to approve a generic drug" and clarified that FDA officials do not "endorse any product." The spokesperson noted that the approval follows established regulatory protocols for generic drug applications.
Standard Regulatory Process
The approval represents routine FDA procedure for generic medications. According to agency documents, Evita Solutions (search) filed its application four years ago, with the FDA typically processing such applications within 10 months. Generic drugmakers generally need only demonstrate that their product matches the ingredients and formula of the original medication.

The FDA first approved the original mifepristone in 2000 and has gradually expanded access over time. The agency approved the first generic version from GenBioPro (search) in 2019. Under the Biden administration in 2021, the FDA permitted online prescribing and mail-order delivery of the drug, significantly broadening access.
Current Treatment Landscape
Mifepristone is typically used in combination with misoprostol for medication abortion. The two-drug regimen accounts for approximately two-thirds of all U.S. abortions. Mifepristone works by dilating the cervix and blocking the hormone progesterone, while misoprostol causes uterine cramping and contractions.
Despite the availability of a second generic option, access to mifepristone remains significantly limited across large portions of the United States due to state laws that ban abortion entirely or impose specific restrictions on medication abortion. These legal restrictions are currently subject to numerous ongoing lawsuits working through the court system.
Regulatory Review Under Scrutiny
The approval comes amid growing pressure on Trump administration health officials to reevaluate mifepristone's safety profile. Health Secretary Robert F. Kennedy Jr. and FDA Commissioner Dr. Marty Makary pledged in a letter to Republican attorneys general last month to conduct a comprehensive review of the drug's safety, despite the medication being deemed safe and effective by FDA scientists over its 25-year approval history.
Evita Solutions (search) states on its website that it "believes that all people should have access to safe, affordable, high-quality, effective, and compassionate abortion care." The company did not respond to requests for comment regarding the approval.
Major medical societies, including the American Medical Association, do not support the current restrictions imposed on mifepristone access. The approval of the second generic version is unlikely to significantly affect overall access to the medication given existing state-level legal barriers.
