FDA Considers Approving Reduced-Risk Marketing Claims for Zyn Nicotine Pouches

The Food and Drug Administration convened a public meeting Thursday to evaluate Philip Morris International (search)'s proposal to market its Zyn (search) nicotine pouches with reduced-risk claims, potentially allowing the company to advertise the products as a less-harmful alternative to cigarettes for adult smokers.
Government documents and FDA presentations suggest regulators are leaning toward approving the company's request to include language stating that Zyn (search) reduces the risk of "mouth cancer, heart disease, lung cancer, stroke" and other smoking-related diseases in promotional materials.
FDA Scientists Support Reduced-Risk Claims
FDA tobacco staffers concluded that the statement about Zyn (search) reducing smoking-related illness risks is "scientifically accurate" after evaluating "the totality of the evidence." The agency's preliminary review noted that Philip Morris provided supporting data despite not conducting long-term health studies of Zyn users.
Research by Philip Morris showed Zyn (search) contained unquantifiable levels of 36 out of 42 carcinogens and other harmful chemicals found in tobacco products. Of the remaining six chemicals detected, FDA reviewers determined the amounts "were below the level that would be expected to pose a health risk."
The company's evidence draws partly from studies of snus (search), a similar oral tobacco product popular in Scandinavian countries. Research in Sweden and other Nordic nations has consistently demonstrated lower rates of lung cancer, mouth cancer and related diseases among snus users compared to cigarette smokers. Philip Morris argues that Zyn (search) presents even lower health risks than snus because it contains only nicotine powder without tobacco leaves.
Expert Panel Raises Questions
Despite the FDA's preliminary support, an independent panel of health experts posed pointed questions about the company's research methodology, underage use risks, and whether the proposed marketing language would effectively encourage smokers to switch products.
"There are very few things that are legally available and worse for you than cigarettes, so it's a pretty low bar to be safer than cigarettes," said Lisa Postow, a panel member and scientist at the National Heart, Lung and Blood Institute.
Cristine Delnevo of the Rutgers Institute for Nicotine and Tobacco Studies, who led the panel, highlighted a key limitation: "Whether or not the claim is going to accelerate that switching, there is no data here to answer that question."
Youth Usage Concerns
Anti-tobacco advocates expressed concerns about potential underage appeal, citing viral social media content from "Zynfluencers" that has accumulated tens of millions of views. Andrew Tardiff of the Campaign for Tobacco-Free Kids noted similarities to Juul, the e-cigarette brand widely blamed for teenage vaping trends.
"Zyn (search) has features that enhance its appeal to young people. It's sold in a variety of flavors. It's easy to conceal. And it can be used discretely," Tardiff said, also pointing to a Zyn rewards program offering electronics, gift cards and apparel.
However, FDA data indicates teenage nicotine pouch use remains relatively low at 2.4% of high school students according to 2024 federal survey data.
Market Dominance and Growth Potential
Zyn (search) represents the overwhelming leader in the U.S. nicotine pouch market, generating more than $3.24 billion in sales last year and capturing over two-thirds of the market share, according to Nielsen data analyzed by Goldman Sachs. While less than 1% of U.S. adults currently use nicotine pouches, the category represents the fastest-growing segment in the tobacco industry.
Philip Morris received FDA authorization for Zyn (search) to remain on the market in January 2024, making it the first nicotine pouch to win federal approval. The company previously obtained reduced-risk marketing approval for its snus (search) products in 2019, though uptake among U.S. smokers has been limited.
"The more you communicate to adult smokers with this type of claim it will hopefully only increase switching to Zyn (search)," said Keagan Lenihan, a Philip Morris vice president.
The FDA is not bound to follow the panel's guidance and faces no deadline for making a final decision on the reduced-risk marketing claims.
