FDA Eliminates Real-World Data Barriers to Accelerate Drug and Device Approvals

FDA Commissioner Marty Makary announced a significant regulatory shift that will allow pharmaceutical and medical device companies to submit real-world evidence in their applications without the previously required individually identifiable patient information. The policy change, announced during an exclusive interview on FOX Business' "Varney & Co." Monday, aims to reduce regulatory barriers and accelerate the approval process for new treatments.
Addressing Regulatory Bottlenecks
The FDA's previous requirements for real-world evidence had created substantial barriers for companies seeking to include this data in their applications. According to Makary, only 12 drugs in the last 14 years had real-world data included in their approval applications due to bureaucratic requirements that made submission impractical.
"Right now, they say that they've been admitting real-world data into applications, but the requirements have been so onerous that only 12 drugs in the last 14 years have had real-world data in their approval application because the requirements just got so bureaucratic," Makary explained.
The previous system required companies to obtain informed consent from every patient included in real-world data sets, a requirement Makary described as "not realistic" given the scope of data involved.
Immediate Implementation for Medical Devices
According to an FDA press release, the agency is immediately eliminating barriers for medical device applications and "similarly intends to consider updating its guidance for drugs and biologics." The new approach allows companies to submit de-identified data that demonstrates how treatments perform outside the controlled environment of clinical trials.
"So you can submit whatever real-world data you want now in your FDA application. We're changing that guidance," Makary stated.
Expanded Data Sources and Review Process
The FDA is encouraging applicants to utilize various databases including the National Cancer Institute's Surveillance, Epidemiology and End Results (SEER) Program, hospital systems databases, insurance claims databases, and electronic health record networks. These sources contain millions of records that can provide "insights that traditional clinical trials cannot capture."
Under the new system, FDA reviewers will evaluate submitted real-world data and provide feedback to companies if the data does not meet standards, rather than preventing submission entirely through prohibitive requirements.
Clinical Trial Requirements Remain
Despite the expanded acceptance of real-world evidence, Makary emphasized that clinical trials remain a cornerstone of the approval process. "We're still requiring a clinical trial for most drugs, unless it's for a rare disease," he noted.
The FDA has also recently announced plans to reduce the default requirement from two clinical trials to "one really well-controlled, statistically powerful trial" for drug applications, representing another streamlining measure.
Expected Impact on Innovation and Costs
Makary projected that the policy changes will have broad implications for pharmaceutical development. "That's going to allow for more innovation and less delays and lower R&D costs, which could translate to lower drug prices," he said.
The shift represents part of a broader initiative to "deliver on President Trump's goal to give more cures and meaningful treatments to Americans, cutting the red tape, streamlining the FDA, modernizing the organization," according to Makary.
