FDA Issues 2,200 Notices to Companies and Researchers Over Unpublished Clinical Trial Results

The US Food and Drug Administration has issued more than 2,200 notices to medical product manufacturers and researchers who have failed to comply with federal requirements to disclose clinical trial results on ClinicalTrials.gov (search). The enforcement action, announced in late March, represents the agency's most significant push for transparency in clinical research data in recent years.
Widespread Non-Compliance Identified
According to an internal FDA analysis, 29.6% of studies that are highly likely to fall under mandatory reporting requirements have no results information submitted to ClinicalTrials.gov (search). The affected studies include interventional trials with a US nexus involving FDA-regulated products that have passed their reporting deadlines. Phase 1 clinical trials and device feasibility studies are excluded from mandatory reporting requirements.
The notices were sent to companies and researchers associated with over 3,000 clinical trials, including some publicly funded studies. These entities either had not submitted required results to ClinicalTrials.gov (search) or had not completed the National Library of Medicine's quality review process.
Publication Bias Creates Knowledge Gaps
FDA Commissioner Marty Makary emphasized the ethical implications of the widespread non-compliance. "Far too often, companies are suppressing unfavorable clinical trial results and keeping them secret from patients and the scientific community," Makary stated. "Those sponsoring clinical trials have an ethical obligation to make results public regardless of the data's influence on the company's share price."
The agency highlighted that the lack of publicly available trial results creates significant knowledge gaps and publication bias that obscures the reality of drug development outcomes. Specifically, regulators noted that missing trial data overrepresents successes while underrepresenting failures, creating a distorted perception of medical product safety and efficacy.
"If you are a doctor deciding whether or not to prescribe a medication to a patient, you deserve to have the best data about clinical studies on that medication," Makary added.
Enforcement Mechanisms and Penalties
Under federal law, the FDA can impose fines of up to $10,000 per day until violations are corrected. However, the agency's website tracking notices of noncompliance for ClinicalTrials.gov (search) reporting indicates that no fines have been levied for such violations in the past five years.
The enforcement process typically begins with Pre-Notices of Noncompliance to encourage voluntary corrective action. If parties continue to be out of compliance, the FDA follows up with formal Notices of Noncompliance and can subsequently seek civil monetary penalties. Since 2021, the agency has issued eight Notices of Noncompliance and 232 Pre-Notices of Noncompliance since 2013, though none have resulted in civil penalties.
Legal Obligations and Compliance Challenges
Attorneys Stephanie Agu and Heidi Gertner from Hogan Lovells (search) noted that manufacturers and researchers may often simply not know they are required to submit clinical trial results or may be unaware of submission deadlines. "When thinking about the public disclosure of clinical trial results, they are more likely to focus on publishing their results in a journal than on a separate requirement to publish them publicly," they explained.
Under current regulations, results must be submitted no later than one year after the trial's primary completion date, although the FDA permits delays under certain circumstances. The attorneys emphasized that companies and researchers should clearly understand their obligations and applicable timing requirements.
Agency's Risk-Based Approach
Dr. Tracy Beth Hoeg (search), acting director of the Center for Drug Evaluation and Research (search), expressed support for the initiative. "We hope that the thousands of messages sent to sponsors and investigators reminding them to publicly report their findings will improve patient safety and keep researchers and the public better informed of the benefits and risks of new and investigational products," Hoeg stated.
An FDA spokesperson described the action as "targeted outreach designed to promote voluntary compliance and facilitate the public availability of results information." The agency emphasized that failure to address potential violations may result in further regulatory action, including publicly published prenotices and notices of noncompliance, as well as civil money penalties.
