TALLAHASSEE — A key AIDS drug program that Florida lawmakers scrambled to rescue earlier this year remains in serious financial jeopardy, according to a new report from the Florida Department of Health (search) released Monday. The AIDS Drug Assistance Program (ADAP), which provides life-saving medications to thousands of HIV-positive Floridians, faces a dramatic decline in pharmaceutical rebates that threatens its long-term sustainability.
The report warns that the state will be unable to secure sufficient funding for ADAP if it continues to serve individuals at 400% of the federal poverty level — an annual income of $62,600. The program, funded through a combination of state money, federal grants, and pharmaceutical rebates, has already weathered significant cuts and participant losses this year.
Rebate Revenue Projected to Plummet
According to the Department of Health report, annual pharmaceutical rebates have historically ranged from $158 million to $200 million. However, for the 2026-2027 fiscal year, the state expects to receive only an estimated $62.8 million — a decline of more than 60% from the upper end of historical levels.
The state attributes this sharp drop to the Legislature's expansion of the income threshold to 400% of the poverty level, which may "shift participants from insured (rebate-generating) models to direct dispense (non-rebate) models." The full impact of this shift will not be known until September, according to the report.
Earlier Cuts Disrupted Care for Thousands
The funding crisis escalated in January when the Department of Health, citing a $120 million shortfall caused by federal funding reductions, announced it would drop the coverage threshold from 400% of the poverty level to 130% — reducing the qualifying annual income from $62,600 to just $20,345.
The change resulted in approximately 11,000 HIV-positive Floridians losing access to life-saving medications and care through the program. The agency also withdrew some of the most popular medications from the approved drug list and stopped paying premiums for Affordable Care Act plans in March.
Notably, the legislative stopgap measure did not restore coverage for Biktarvy, the most popular once-a-day pill for HIV treatment, and other medications were switched to generic versions.
Legislative Response and Ongoing Shortfall
In response to the crisis, the Legislature passed a stopgap measure that included $31 million to restore cuts to ADAP through June 30, the end of the fiscal year. The measure also imposed new reporting requirements, mandating that the Department of Health submit monthly accounting reports about the ADAP program to the Legislature.
For the budget for the next fiscal year, which begins July 1, the state set aside $75 million for ADAP. This falls more than $40 million short of what the Senate sought to fund the program, while the House had originally proposed $68 million.
Growing Enrollment Amid Funding Constraints
The report highlights that the number of people enrolled in ADAP has grown by 9,000 over the past five years. As of last month, 27,757 people are enrolled in ADAP in Florida, underscoring the expanding demand for the program at a time when its financial foundation is increasingly uncertain.
