Health Canada Generic Drug Approval Delays Threaten Patient Access and Healthcare Cost Savings

The federal agency hit its 180-day approval timeline only 84% of the time in the fiscal year ending March 31, 2025, down from 94% the previous year and 100% in three other recent years.
The delays have direct implications for patient access to affordable medications and healthcare system costs. Generic drugs, which are copies of branded pharmaceuticals whose patents have expired, typically cost 25-35% of the original drug's price when multiple competitors enter the market.
Rising Application Volume and Complexity
Health Canada attributes the delays to a substantial increase in workload and complexity. Between 2016 and 2025, the regulator saw a 43% rise in generic drug applications and an increase of more than 200% in submissions related to changes for generics already on the market. The complexity of submissions has also increased, leading to a more than 30% rise in the average number of review hours per submission over the past five years.
"Health Canada acknowledges they're picking up submissions late," said Jim Keon, president of the Canadian Generic Pharmaceutical Association (search) (CGPA). "They are short of resources. There's a higher submission volume. The products are becoming more complex that they need to review, and they've had difficulty keeping up."
Last-Minute Decisions and Reset Clocks
The approval process issues extend beyond simple timeline delays. In 70% of cases in 2024-25, Health Canada issued rulings with a week or less remaining before the 180-day deadline. Nearly three-quarters of these last-minute decisions resulted in rejections, requiring companies to provide additional information and resetting the review clock with no defined timeframe.
The regulator's first-round rejection rate has increased dramatically, rising from 49% in 2019-20 to 73% in 2024-25. Despite these initial rejections, 90% of generic applications were ultimately approved last year.
Health Canada stated that reviewers have issued more negative decisions after first review in recent years due to "deficiencies related to safety, efficacy and quality."
Industry Concerns Over Standards and Timing
Generic manufacturers dispute Health Canada's characterization of submission quality. The CGPA argues that Health Canada sometimes requests impurity testing or bioequivalence studies that exceed requirements in the United States and Europe.
"I think the issue is, if you wait eight months to be told that, 'Oh, your file is missing something,' then you've lost eight months," said Michel Robidoux, president and general manager of Sandoz Group AG's Canadian operations.
Michael Law, a pharmaceutical policy researcher at the University of Calgary, suggested the delays could partially result from manufacturers filing incomplete applications. "If the average submission has been getting worse over time, however, then it might be the case that it does take a longer time to parse the data and determine the decision," he noted.
Economic Impact on Healthcare System
The approval delays have significant financial implications for Canada's healthcare system. Generic drug prices are structured to decrease as more competitors enter the market, starting at 75-85% of the brand price for the first generic, dropping to 50% with two competitors, and falling to 25-35% with three or more entrants.
Sandoz highlighted five generic drugs under Health Canada review since 2023, four of which would trigger price reductions as second or third market entrants. These include sapropterin for phenylketonuria (search), a rare inherited metabolic disorder, and palbociclib for breast cancer (search) treatment.
Fee Increases Without Performance Gains
Adding to industry frustration, Health Canada increased application fees starting in 2020, with fees for new generic applications reaching $70,750 in 2025, up 39% from 2020 levels. These increases came with promises to speed up processing times that have not materialized.
The regulator meets its performance target as long as it issues a first approval or rejection within 180 days. Missing this deadline triggers a 25% refund of the application fee, but subsequent reviews have no time constraints or financial penalties for Health Canada.
Robidoux questioned why regulatory harmonization with peer countries hasn't improved efficiency: "Why would a drug be approved in six months with the same submission documentation in Europe and lag approval in Canada?"
