Seskin's husband, Robert Sugarman, claims that asbestos present in Johnson & Johnson's Baby Powder—which Seskin used for decades—caused her fatal disease. Michael Pendell of Motley Rice (search), representing Sugarman, told jurors that evidence would demonstrate J&J knew its talc products contained asbestos and was aware of associated dangers for decades, yet failed to warn the public.
"If Johnson & Johnson had told the truth about its Baby Powder, that it contained asbestos and caused cancer, this didn't have to happen," Pendell said during his opening statement.
Pendell further alleged that despite scientific evidence linking talc to cancer, the company engaged in a campaign to deny and discredit those findings.
J&J's Defense Strategy
In response, J&J maintains its talc products are safe and contends that Seskin's cancer stemmed from other causes. "Ms. Seskin's cancer wasn't caused by Johnson's Baby Powder," Bueno stated. "No causation, no case."
