Michigan Senate Approves Prescription Drug Affordability Board to Combat Rising Medication Costs

The legislation passed on Thursday, April 24, by a 20-15 vote, with all 19 Democrats and one Republican, Sen. John Damoose of Harbor Springs, voting in favor. The bills now face an uncertain path forward in the Republican-controlled House.
Board Structure and Powers
The proposed board would consist of five members appointed by the governor, each serving four-year terms. Members would need expertise in healthcare, economics, health policy, health equity, clinical medicine, or hospital pharmacy administration, with at least one member required to be a patient advocate.
The board would be empowered to:
- Conduct affordability reviews on specific prescription drugs
- Set upper payment limits if they determine spending on a product leads to affordability challenges
- Require insurers and Medicaid to comply with established price caps
- Conduct a one-time comprehensive study on prescription drugs and their costs
Additionally, a 21-member drug affordability stakeholder council would be established, including representatives from pharmaceutical manufacturers, insurance companies, healthcare workers, and patient advocates.
"This board isn't about setting prices, it's about reviewing specific drugs, under specific circumstances, where our citizens frankly aren't getting as good a deal as everyone else," said Sen. Damoose, the lone Republican supporter.
Addressing a Growing Crisis
The legislation comes amid mounting concerns about prescription drug affordability in Michigan (search). According to AARP Michigan (search), about 75% of Michiganders rely on prescription medications, yet 58% have forgone filling prescriptions due to financial constraints.
A 2022 federal analysis found U.S. prices across all drugs were nearly 2.78 times higher than in comparison countries, and 3.22 times higher for brand-name drugs. Insulin products, for example, were nearly 10 times more expensive in the U.S. compared to 33 comparison countries.
"Michiganders are rationing their medication, skipping doses or going without it altogether due to high costs," said Sen. Darrin Camilleri, D-Brownstown Township, who sponsored the bills.
Sen. Damoose highlighted that residents in his district regularly cross the border to Canada to purchase more affordable medications. He cited an unnamed drug that costs $3,000 per month in the U.S. but only $80 a month in the United Kingdom.
"Half of these drugs are invented here in the U.S., many in our publicly funded universities or developed with significant federal research funding," Damoose noted. "Is there no upside for the American consumer for all of this investment that they are making?"
Opposition and Concerns
The pharmaceutical industry and most Republicans strongly oppose the legislation. Stami Turk, Director of Public Affairs for PhRMA (search), called the proposed board "a disaster for patients" that would give "unelected bureaucrats a veto pen over the medicine or the treatments doctors prescribe and patients need."
Senate Minority Leader Aric Nesbitt, R-Porter Township, described it as a "Soviet-style price-fixing scheme" and a "bureaucratic boondoggle" that hasn't worked in other states.
Sen. Thomas Albert, R-Lowell, argued that capping drug prices is anti-competition and anti-free market, potentially opening opportunities for corruption. "If you take away freedom in the economy, you take away freedom in society as a whole," Albert said.
The Michigan Chamber of Commerce (search) also opposes the creation of the board, warning it could negatively impact consumers and the future of critical medicines, and has proven costly for other states with similar legislation.
Precedent and Prospects
Minnesota, Colorado, Washington, and Maryland have created similar boards with prescription drug price-setting powers. A 2024 review in the journal Health Affairs found that the long-term impacts of those price controls "on benefit design, patient access and innovation are not yet known."
Governor Gretchen Whitmer first called for the creation of a Prescription Drug Affordability Board (search) in August 2023, but the legislation failed to gain traction even when Democrats controlled both chambers. A previous version passed the Senate in October 2023 along party lines but was never taken up by the House.
The current bills face significant hurdles in the Republican-controlled House. Speaker Matt Hall, R-Richland Township, called it a "very controversial proposal" and referred the package to the Government Operations Committee, a panel where legislation is often sent to die.
AARP Michigan (search) State Director Paula Cunningham urged the House to "follow suit and help put an end to the outrageous and unsustainable drug prices that have burdened our communities for far too long."
Legislators estimate the board would cost the state approximately $4-5 million annually, covering three full-time workers, administrative expenses, data analysis, legal resources, and contracting with third-party entities.
As prescription drug costs continue to rise, this legislation represents Michigan (search)'s attempt to join other states in addressing what many see as a growing healthcare crisis affecting millions of residents.
