New ACIP Charter Broadens Criteria, Refocuses Mission Amid Legal and Public Health Uncertainty

A new charter for the Advisory Committee on Immunization Practices (ACIP), posted to the CDC's website on Thursday, substantially refocuses the responsibilities of the panel that has guided U.S. vaccine policy for more than 60 years. The document, dated May 14, downplays the committee's traditional role in recommending new vaccines and instead tasks it with assessing alternatives to vaccines for disease prevention — a shift that public health experts describe as an effort to align the committee with Health Secretary Robert F. Kennedy Jr.'s longstanding vaccine skepticism.
Whereas previous iterations of the ACIP charter stressed the importance of vaccine research-relevant experience in member selection, the new version merely stipulates that the panel as a whole should "represent a balanced range of scientific, clinical, and public health expertise relevant to the Committee's mission." This broad language, experts warn, could allow individuals with little to no experience in vaccines or vaccination policy to serve.
A Charter Rewritten to Withstand Legal Challenge
The charter revision follows a March federal court ruling that effectively suspended ACIP after a judge found that Kennedy had violated lawful procedure when he fired the previous committee en masse in June 2025 and replaced it with a group of vaccine skeptics. The preliminary ruling determined that most members of the new committee lacked the qualifications required to fulfill their duties, leaving ACIP in limbo. The Trump administration has appealed the order.
"When the court tells you that many of your appointments fail to meet the charter criteria and therefore the results of their deliberations must be set aside, change the charter," said Sara Rosenbaum, professor emerita of health law and policy at George Washington University's Milken Institute School of Public Health.
Rosenbaum characterized the changes as an attempt to "superimpose on the science itself his deep prejudice against one of the truly surpassing achievements in child health," adding that Kennedy has "altered its mission to somehow support his preferred aim of somehow proving that vaccines are dangerous, altered the qualifications of its advisors, and stacked its operations with staff who share his views."
Paul Offit, a pediatrician and vaccine expert at Children's Hospital of Philadelphia, concurred: "RFK Jr. is trying to retrofit the charter to make it so that the people that he brought in … qualify. So therefore, he's trying to make it so that we don't have an expertise that can best advise us."
Richard Hughes, the lawyer who brought the legal challenge against the reformatted ACIP on behalf of the American Academy of Pediatrics, said the new charter is aimed at making a Kennedy-selected committee less vulnerable to legal challenge. "The March charter was an overt attempt to shift ACIP's focus to match Kennedy's vaccine agenda — vaccine injury, cumulative exposure, vaccine components, mRNA (search) platforms, and safety gaps — while adding non-traditional liaison groups and moving control closer to CDC leadership," Hughes said. "Here, they are simply trying to minimize what they are doing on paper to avoid the legal consequences of their manipulation of the committee."
Refocusing on Alternatives to Vaccines
Charlotte Moser, a member of the former ACIP who was fired by Kennedy in June 2025, expressed particular concern about the committee's new emphasis on finding alternatives to vaccines for disease prevention. "The revised text suggests that rather than focusing on how to effectively and safely use vaccines, the committee should be comparing vaccines with 'other preventive measures' and advising on 'gaps and limitations in evidence,'" Moser said.
The new charter also reduces the direct acknowledgment that ACIP recommendations drive access through the Vaccines for Children (VFC) program and influence insurance coverage — a critical function that ensures more than half of American children can receive immunizations at no cost.
Fall Vaccination Campaigns in Jeopardy
The ongoing ACIP suspension has created what experts describe as unprecedented ambiguity around the upcoming fall immunization season. In a typical year, ACIP would convene to issue recommendations on seasonal influenza (search) and COVID-19 (search) vaccines after FDA approval, guiding health-care provider advice and triggering insurance coverage. Currently, no functional ACIP exists to perform this role.
"Even those of us who follow this 24/7 don't completely understand where anything stands right now," Michelle Fiscus, a pediatrician and the chief medical officer of the Association of Immunization Managers, told The Atlantic.
Many experts remain tentatively optimistic that Americans will still be able to access flu vaccines this fall. A spokesperson for Sanofi, one of the main U.S. flu vaccine manufacturers, confirmed that preorders for both flu shots and the Novavax COVID vaccine have already been placed. "Strain selection — part of FDA approval — is the critical step to ensure timely manufacturing, not ACIP," the spokesperson noted.
However, the situation for COVID-19 (search) vaccines appears more precarious. Last year, Kennedy's ACIP did not issue guidance on COVID vaccines until September, then softened the recommendations for their use, sowing confusion among pharmacies, doctors' offices, and patients about eligibility and insurance coverage. Several experts anticipate similar issues this autumn if ACIP delays or skips its recommendations.
Whether the federal Vaccines for Children Program can offer the shots remains a gray area. ACIP is the sole arbiter of which vaccines are included in the VFC program, and the committee normally convenes a new VFC vote each time it recommends a new flu vaccine, according to Grace Lee, a former ACIP chair. Experts consulted were divided on how necessary such a vote would be to ensure access to the new COVID and flu shots.
Administration's Next Steps
HHS is considering multiple pathways forward. Andrew Nixon, HHS's deputy assistant secretary for media relations, wrote that the legal ruling "has impeded ACIP's ability to carry out its established review process for influenza (search) and COVID-19 (search) vaccines" but that "HHS is considering all available options to ensure access to these vaccines."
Among the possibilities: the administration could attempt to cobble together a new vaccine advisory committee in the coming weeks or months; acting CDC Director Jay Bhattacharya could issue recommendations directly, leapfrogging the ACIP process; or the administration could simply do nothing, betting that the vaccine-delivery pipeline will function without ACIP's formal guidance.
Any path forward carries legal risk. "If they come out and basically repeat prior recommendations that we've challenged, then I'm going to certainly take issue with that," Hughes warned.
In the meantime, experts repeatedly emphasized that ACIP's eventual return is essential — to recommend brand-new vaccines against emerging diseases and to align the nation on a single, collective immunization schedule. But they also acknowledged that, for now, the U.S. vaccination system must find a way to function without the committee that has anchored it for six decades.
