Florida and Texas filed a federal lawsuit Tuesday in Wichita Falls, Texas, seeking to invalidate FDA decisions dating back to 2000 that approved and later loosened restrictions on mifepristone. The 120-page complaint argues that the FDA's actions were "arbitrary" and an "abuse of discretion" under the Administrative Procedure Act.
The lawsuit names the FDA, the U.S. Department of Health and Human Services (search) and agency leaders as defendants. It claims federal policies conflict with state abortion limits passed after the U.S. Supreme Court overturned Roe v. Wade in 2022.
The states cite an 1873 law, the Comstock Act, in asserting that abortion drugs cannot legally be mailed. The lawsuit seeks to roll back FDA actions that expanded access to the drug, arguing they violate both federal law and state abortion restrictions.
Missouri, Kansas and Idaho Challenge Generic Approval
Three additional Republican-led states have challenged the FDA's approval of a generic form of mifepristone. The attorney generals for Missouri, Kansas and Idaho filed an amended complaint in their ongoing lawsuit against the FDA to restrict mifepristone usage, specifically targeting the agency's September approval of a new generic form.
"Mifepristone is sending women to the hospital with life-threatening complications, and yet drug companies continue pushing new versions of it into the market without basic medical safeguards," Missouri Attorney General Catherine Hanaway said in a press release announcing the new complaint.
"Mail-order abortion drugs are dangerous when taken without in-person care, and Missouri will not stand by while manufacturers gamble with women's lives," she continued.
FDA's Regulatory Evolution Under Scrutiny
The FDA first approved mifepristone in 2000 and has since updated its regulations multiple times. Key changes include expanding gestational limits from 49 to 70 days in 2016, allowing non-physicians to dispense the drug and lifting in-person dispensing requirements in 2021 and 2023. Those changes coincided with major political shifts and were implemented under Democratic administrations.
After Roe v. Wade was overturned in 2022, Florida, Texas and other Republican-led states enacted more restrictive abortion laws. Florida's six-week abortion limit took effect in May 2024 and includes in-person dispensing requirements and a ban on telehealth abortions.
Trump Administration's Position and Review
The Trump administration has defended access to mifepristone despite the ongoing legal challenges. Regarding the generic approval, White House press secretary Karoline Leavitt explained the administration's position: "It's not an endorsement of this drug by any means. They are just simply following the law. By law, the secretary of the Department of Health and Human Services must approve a generic drug application if the application demonstrates the drug is the 'same' as the brand-name drug."
However, Health and Human Services Secretary Robert F. Kennedy Jr. ordered the FDA to review mifepristone's safety earlier this year, with FDA Commissioner Marty Makary pledging to do so in June. The administration's review of mifepristone has concerned reproductive rights advocates, who worry that the review will result in restrictions of the drug.
Scientific Evidence and Safety Profile
Researchers and scientists have studied the effects of mifepristone on users for decades and have found the drug to be safe and effective at ending pregnancies. The FDA currently classifies mifepristone as safe when it's used "as indicated and directed."
Uncertain Legal Landscape
It remains unclear how quickly the federal court will take up the case or how it may interact with two other ongoing lawsuits involving mifepristone access. The long-term effect on nationwide availability of the drug is uncertain, especially as state-level abortion bans continue to evolve.
