Sarepta Therapeutics, its affiliate Sarepta Therapeutics Three, REGENXBIO, the Trustees of the University of Pennsylvania and Catalent entered into a settlement on September 23, 2026 that resolves patent infringement litigation and related appeals involving several U.S. patents covering AAVrh74 (搜索)-based gene therapy technology.
Under the agreement, Sarepta will pay REGENXBIO a lump sum of $39 million within ten days of the effective date. Sarepta had already recorded a $39 million litigation contingency charge for the second quarter of 2026. All parties will dismiss the disputes with prejudice and bear their own legal costs.
REGENXBIO and UPenn released Sarepta, Catalent and their affiliates from past claims and agreed not to sue over alleged infringement of specified UPenn patents by any Sarepta gene therapy product using an AAVrh74 (搜索)-based capsid, including ELEVIDYS. REGENXBIO also agreed not to pursue infringement claims under any of its patents or applications covering the existing form of ELEVIDYS or the AAVrh74 capsid sequence. No party admitted liability.
