South Korea Revisits Mifepristone Approval Amid Seven-Year Abortion Law Vacuum

President Lee Jae-myung has reignited South Korea's long-stalled abortion policy debate, calling on the government to expedite the introduction of mifepristone — the medication widely used for medical abortion in over 100 countries — during a Cabinet meeting on Tuesday. The president's intervention comes seven years after the Constitutional Court struck down the country's abortion ban, a period during which the National Assembly has failed to enact replacement legislation.
"Even if it creates some difficulties for the government, women should be able to receive the medication under appropriate medical supervision. Leaving the situation as it is now is irresponsible," Lee said, also suggesting that physicians be granted greater discretion to prescribe the drug until a new legal framework is established.
Interagency Talks Underway
The president's remarks prompted swift action from relevant ministries. A Gender Equality and Family Ministry official confirmed Thursday that the ministry, alongside the Ministry of Food and Drug Safety (search) (MFDS) and the Ministry of Health and Welfare, opened interagency talks on Wednesday to discuss the possible introduction of mifepristone.
The MFDS has long maintained that the regulatory vacuum is the central obstacle. "The law does not clearly define the scope or time limits for medication-induced abortions, creating practical difficulties in reviewing the drug's efficacy, safety and risk management plan," an MFDS official stated Wednesday. The agency added that it plans to continue discussions with the health ministry and the gender ministry as the need for the drug's introduction continues to be raised.
A Seven-Year Legislative Vacuum
The current impasse traces back to the Constitutional Court's landmark 2019 ruling, which declared the criminal provision on abortion incompatible with the Constitution and ordered lawmakers to revise the law by the end of 2020. Although the criminal provision lost its legal effect after the deadline passed, the National Assembly has yet to pass replacement legislation defining when and under what conditions abortions are permitted.
Several bills to revise the Maternal and Child Health Act remain pending in the National Assembly. These proposals vary in their approaches to gestational limits, counseling requirements, and rules governing medication abortions, but each seeks to fill the legal vacuum left by the court's ruling.
Mifepristone's Regulatory Status
Mifepristone, commonly known overseas as Mifegyne or Mifeprex, is included on the World Health Organization's Model List of Essential Medicines and is widely used in more than 100 countries. In South Korea, however, an application for marketing approval has remained under review for years without resolution.
Women's rights groups have argued that bringing mifepristone into the formal healthcare system would reduce reliance on illegal distribution channels and overseas purchases while ensuring safer medical oversight.
Medical Community Divided
The Korean Association of Obstetricians and Gynecologists (search) has taken a firm stance against the drug's introduction under current conditions. In a recent statement, the association said that introducing mifepristone without replacement legislation and adequate medical verification "is a dangerous idea that threatens women's health." The group further warned that allowing the drug before safety guidance and a proper distribution system are in place would amount to "turning the public into subjects of a dangerous experiment."
The debate now centers on whether regulatory agencies can establish a pathway for mifepristone approval in the absence of comprehensive abortion legislation, or whether the National Assembly must first resolve the seven-year legislative impasse.
