The draft guidance distinguishes between two key forms. Form FDA 3542a is used when an NDA applicant submits information on a patent that claims a drug substance, drug product, or method of using the drug that is the subject of an unapproved original NDA, amendment, or supplement. Form FDA 3542, in contrast, is designated for NDA holders submitting the same information for an approved NDA or approved supplement.

Submission Timelines and Requirements
The guidance outlines specific deadlines for patent information submission. NDA holders must submit the required patent information to the Orange Book within 30 days of receiving an NDA or NDA supplement approval. If a patent is issued after the NDA is approved, the NDA holder must submit Form FDA 3542 within 30 days of the patent's issuance. Should the FDA identify errors or omissions in the submitted form, the NDA holder will have 15 days to refile following agency notification.
NDA applicants and holders are required to submit information including the patent number and patent expiration date for each patent where a patent infringement could reasonably be asserted. For patents claiming only a polymorph that is the same as the active ingredient described by the NDA, the applicant or holder must certify that they have test data demonstrating the drug product containing the polymorph will perform the same as the drug product described in the NDA.

Correcting Use Codes: The guidance makes clear that NDA holders cannot simply modify an existing Use Code. Instead, they must expressly state their intention to "remove" the existing Use Code and "add" a new Use Code in field 1.h. This reflects agency policy that has been in place for several years.
Submission Procedures: Only NDA holders, or their agents, attorneys, or representatives, may submit Forms 3542a and 3542. While the patent owner — if different from the NDA applicant — may assist in completing and even signing the forms, only the NDA applicant may submit them to the FDA. The guidance also reminds NDA holders to submit forms electronically through the Electronic Submissions Gateway and not to send courtesy copies to the Orange Book staff or through other agency channels.
Discontinued Drug Products: For products that have been withdrawn from marketing but whose NDAs remain approved, the FDA reiterates that NDA holders have an ongoing obligation to submit patent information, including for newly issued patents.
