Ukraine Adopts Bolar Rule to Accelerate Generic Drug Market Entry

On May 15, Ukraine's Verkhovna Rada (搜索) approved legislation implementing the Bolar Rule (搜索) with 265 parliamentarians voting in favor of draft law No. 13087. This significant pharmaceutical policy change allows generic drug manufacturers to begin registration processes and production before original drug patents expire.
The Bolar Rule (搜索), widely implemented internationally and reflected in EU Directive 2001/83/EC, permits generic drug developers to conduct research, complete regulatory procedures, and produce medicines prior to patent expiry—though commercial sale and promotion remain prohibited until patent protection officially ends.
"The Bolar Rule (搜索) gives manufacturers the right to start registering and manufacturing generic drugs before the expiration of the original drug patent," explained Mykhailo Radutskyi, Chairman of the Verkhovna Rada (搜索) Committee on National Health, Medical Assistance and Medical Insurance.
Breaking Pharmaceutical Monopolies
The legislation specifically targets monopolistic practices in Ukraine's pharmaceutical market. Without the Bolar Rule (搜索), original drug manufacturers effectively maintained market exclusivity beyond their patent terms, as generic competitors faced years of additional testing and approvals before market entry.
Under the new law, generic alternatives can be registered immediately after patent expiration, significantly reducing the time gap between patent expiry and market availability of more affordable alternatives. This regulatory change is expected to increase competition and ultimately lower medication costs for Ukrainian patients.
"The adoption of draft law No. 13087 will increase competition between manufacturers of generic drugs and reduce drug prices for patients," Radutskyi noted, adding that supporting domestic producers remains a state priority.
Implementation Timeline and Background
The implementation of the Bolar Rule (搜索) has been in development since 2020 in Ukraine. In February 2025, the National Security and Defense Council (搜索) designated its full adoption as a priority measure to improve public access to medications and reduce pharmaceutical costs.
The legislation represents part of a broader effort to reform Ukraine's pharmaceutical market. On March 1, new regulations came into force, including Cabinet of Ministers (搜索) Resolution No. 168, which introduced restrictions on markups and retail margins for all drugs, not just certain categories.
The law will enter into force the day after its official publication, marking a significant step toward pharmaceutical market liberalization in Ukraine.
International Context
The Bolar Rule (搜索), named after a U.S. court case (Roche Products v. Bolar Pharmaceutical), has become a standard regulatory practice across developed pharmaceutical markets. Its implementation in Ukraine aligns the country's pharmaceutical regulations more closely with European Union (搜索) standards.
By allowing preparatory work before patent expiration, the rule effectively balances intellectual property protections for innovator companies while ensuring timely access to more affordable medications once those protections legitimately end.
For Ukrainian patients, this regulatory change promises to expand access to essential medications by accelerating the availability of cost-effective generic alternatives in the domestic market.
